The draft law implements the requirements of the EU AI regulation from June 2024, as the German government announced. It creates a uniform framework across the Union for the development, deployment and use of AI systems. The goal is to promote innovation, protect fundamental rights and strengthen trust in the technology.
The draft law determines which national authorities at federal and state level will be responsible for market surveillance and notification of AI systems in the future. The government is drawing on existing structures to avoid duplication of work and to use existing expertise. Companies are to receive clear points of contact.
A core element is the central role of the Federal Network Agency. It will set up a coordination and competence centre that bundles AI expertise and makes it available to other authorities and companies. In addition, the agency is to establish at least one AI real-world laboratory where innovative AI systems can be tested.
