A US federal judge has dismissed the criminal case against Salvadoran migrant Kilmar Ábrego García, calling the prosecution an 'abuse of prosecutorial power,' according to the Tagesspiegel.

The Ábrego García case made international headlines last year. The man, married to a US citizen, was deported to El Salvador in March 2025 along with more than 200 other migrants and imprisoned in a notorious prison — despite a 2019 court order barring his deportation due to the danger to his life. The US government later admitted an ‘administrative error.’

After his return to the US, Ábrego García was arrested again. Prosecutors accused him of smuggling migrants without valid documents. Judge Crenshaw ruled that the charges would never have been filed had Ábrego García not successfully challenged his deportation. The decision is a slap in the face for Donald Trump and the Justice Department.

Trump repeatedly called Ábrego García a member of the Salvadoran MS-13 gang and a ‘terrorist’ — without providing evidence. Ábrego García was released from custody in August, but still faces deportation.
