Citizen Initiative Against Pullach Chemical Plant Fails Again in Court

The Bavarian Administrative Court in Munich dismissed the lawsuit filed by the initiators of a citizen initiative aimed at halting the land-use planning for the conversion of the Pullach chemical plant. This marks the third legal defeat for the project's opponents.

The Bavarian Administrative Court in Munich has dismissed the lawsuit filed by the initiators of a citizen initiative to stop the land-use planning for the conversion of the Pullach chemical plant. This is now the third legal defeat for the opponents of the project. The initiators had sought to have their citizen initiative declared admissible.

The citizen initiative, titled “Stop the Land-Use Planning on Dr.-Gustav-Adolph-Straße,” targets the plans of the chemical company United Initiators. The firm presented the “Big Wings” project in 2019, which envisions a conversion on the factory premises in the Pullach district of Höllriegelskreuth. The municipality of Pullach subsequently initiated a revision of the development plan.

The municipality initially declared the citizen initiative admissible but later reversed this decision during a meeting of the holiday committee, partly because the initiators had taken legal action against a council initiative. As early as October 2022, the Munich Administrative Court rejected an urgent motion by the initiators, ruling that the reasoning behind the citizen initiative was misleading in key points. The Bavarian Administrative Court of Appeal dismissed a complaint by the initiators in March 2023.

During the recent oral hearing, the lawyer representing the municipality of Pullach moved to dismiss the lawsuit as inadmissible, arguing that no ongoing land-use planning procedure existed. The municipality had adopted the new development plan in April 2023. The plaintiffs’ lawyer countered that the withdrawal of the citizen initiative had been unlawful. Presiding Judge Christine Gibbons did not yet disclose the reasons for the decision during the hearing. After the written judgment is served, the plaintiffs will have one month to file an appeal.
