The Committee of Ministers of the Council of Europe adopted a declaration on Friday in Chisinau, the capital of Moldova, clarifying the rights under Articles 3 and 8 of the European Convention on Human Rights. This decision, initiated by Italy, facilitates certain deportations of migrants, including to so-called “return centers” in third countries.
Massimo Dell’Utri, the Italian Undersecretary of State for Foreign Affairs, stated, “It is crucial to respond to the challenges of our time with new instruments.” He emphasized the need to effectively manage irregular migration and ensure national security.
The declaration makes it clear that the prohibition of torture and inhuman or degrading treatment remains absolute. However, it also emphasizes that the assessment of the minimum severity of mistreatment is relative and depends on the circumstances of each case.
Giorgia Meloni, the Italian Prime Minister, expressed her positive views on the summit’s outcomes. She described the Chisinau declaration as an important success and highlighted that the Italian approach to managing migration flows is now recognized by the other 46 member states of the Council of Europe.
