AfD Bavaria: Intelligence agency may continue surveillance

The Bavarian Administrative Court has ruled that the state's intelligence agency may continue to monitor the AfD party, citing its unconstitutional positions on remigration.

The Bavarian Administrative Court dismissed an appeal by the AfD’s state chapter against a ruling by the Munich Administrative Court. The party’s statements on remigration exceed the limits of permissible criticism of the democratic system, the court said. The decision is final.

The surveillance was based on a report by the Federal Office for the Protection of the Constitution from June 2021. AfD had already lost in the main proceedings, and the administrative court had not allowed an appeal at that time. The failed attempt to force an appeal was the party’s last legal recourse.

The AfD chapter is meanwhile embroiled in an internal power struggle. At the state party congress in October, an attempt to remove the board failed because it did not achieve the required two-thirds majority. Federal chairwoman Alice Weidel recently called on the chapter to show unity.
