The 74-year-old, who came to Germany as a refugee in the 1990s, had filed a lawsuit against the revocation of his deportation ban. The Federal Office for Migration and Refugees (Bamf) had justified the revocation with the dissolution of the PKK. During the oral hearing, the court made clear that the human rights situation in Turkey for suspected terrorist involvement remains inadequate.
Presiding Judge Dirk Schäfers stated that the court assumes the plaintiff was significantly involved in the PKK, for instance through combat participation. What matters, however, is whether the risk of torture in the destination country has durably improved. The reform process in Turkey is still in its early stages, Schäfers said.
In light of the court’s clear words and the plaintiff’s state of health, the Bamf withdrew the revocation right in the courtroom. The proceedings were then discontinued. The Turkish government accuses the man of PKK membership and sixfold murder; in 1992, he faced the death penalty there.
