Heatwave: Your Rights When Working in High Temperatures

When temperatures rise, employees have certain rights. From 26 degrees Celsius, employers must take protective measures; above 35 degrees, work is considered unreasonable.

Summer heat in the office: Employees in Germany do not have a general right to heat leave. The employer decides when and where work is done, but must consider the health interests of the staff. During pregnancy or with cardiovascular diseases, working in very warm offices may be unreasonable – in such cases, heat leave is possible.

The workplace regulation ASR A3.5 Room Temperature provides guidelines: From 26 degrees Celsius, the employer must take measures such as flexitime, fans, or free drinks. If the temperature rises above 35 degrees, work is considered unacceptable. Affected employees can then demand another room or time off.
