The Freising District Office has decided that Friedrich Moser (PFW) must resign his seat on the Allershausen municipal council. The authority sees a conflict of interest between Moser’s work as building yard manager and his volunteer role as a council member.
The district office bases its decision on the Bavarian municipal code. This prohibits civil servants and employees of a municipality from serving as volunteer council members in the same municipality. An exception applies only to employees who perform predominantly physical work. The municipal electoral committee had previously declared Moser’s candidacy admissible before the local elections and involved the supervisory authority – at the time, according to Mayor Martin Vaas, there were no objections.
Mayor Vaas expressed surprise at the district office’s late decision. “This is a loss of information and knowledge,” Vaas said. Moser declined to comment on the ongoing proceedings.
