“Spiegel” is refusing to accept the Hamburg Higher Regional Court’s (OLG) June injunction, which prohibits certain passages about allegations made by Ulmen’s ex-wife Collien Fernandes. A magazine spokesperson told the Evangelical Press Service on Thursday that they have filed a motion at the Hamburg Regional Court demanding Ulmen file a main action lawsuit. There is no direct legal recourse against the OLG ruling itself.
If Ulmen does not file the main action lawsuit within a set deadline, the OLG order could be declared void. The main proceedings would then begin anew at the Hamburg Regional Court and could ultimately reach the Federal Court of Justice. Currently, “Spiegel” is barred from suggesting that Ulmen created or distributed deepfake videos of his ex-wife – the OLG found insufficient evidence for such claims.
The dispute stems from a March article in “Spiegel” titled “Exposed on the Net” and a nearly identical online piece headlined “Criminal Complaint Against Christian Ulmen – “You Virtually Raped Me””. Fernandes made serious allegations against her ex-husband, including identity theft. Christian Ulmen is presumed innocent.
